Texas Divorce Grounds

If you are considering filing for divorce in Texas, you might be wondering what reasons you can use. There are a few different grounds your divorce can fall under.

Insupportability – This is when the marriage can’t be supported anymore due to irreconcilable differences and no hope of repair. Couples who want to file for a “no-fault” divorce would choose this option.

Other “at-fault” divorce options include:

Separated – This refers to a three-year separation before filing for divorce.

Mental disorder – This is when one spouse has been in a mental institution for three or more years and is unlikely to recover. If that’s the case, the other spouse can file for divorce based on this ground.

Cruelty – A spouse can claim that he or she is treated with cruelty by the other spouse.

Abandonment – If one spouse has left and been gone for at least one year, then the other spouse can use this as a fault for the divorce.

Convicted of a felony – This is when one spouse has been convicted of a felony and imprisoned for one year or more.

Adultery – The stipulation for this fault is that the spouse claiming adultery occurred must be able to prove it.

Like most states, Texas has a residency requirement for a couple who wishes to file for divorce in the state. At least one of the spouses must be a Texas resident for 6 months or more before the couple can file for divorce.
